FLKD Privacy Policy

FLKD LLC (“FLKD,” “we,” “us,” or “our”) operates the FLKD sports photography marketplace, including our website, mobile applications, photographer profiles, booking tools, and related services (collectively, the “Services”).
This Privacy Policy explains the information we collect, how we use and share it, and the choices available to you.
Information We Collect
We may collect information you provide directly to us, including your name, email address, phone number, account credentials, profile information, location information you choose to provide, booking information, messages sent through FLKD, reviews, customer support communications, and other information you submit through the Services.
For photographers, we may also collect information such as your business or professional information, portfolio content, service areas, sports you photograph, packages, availability, Travel Availability, date of birth, and information necessary to determine eligibility to use photographer features.
Payment, identity-verification, tax, bank-account, and payout information may be collected or processed by payment and identity-verification providers such as Stripe. FLKD generally does not store complete payment-card or bank-account credentials.
We may also automatically collect device and usage information, such as IP address, browser or device type, operating system, pages or features used, referring pages, timestamps, crash information, and similar technical information.
Sources of Personal Information
FLKD collects personal information directly from you when you create or use an account, complete a photographer profile, submit or accept a booking, communicate through FLKD, contact support, or otherwise use the Services.
FLKD may also collect limited information automatically from your browser, device, or use of the Services, and may receive information from service providers that support payments, identity or payout verification, hosting, security, analytics, communications, or other marketplace operations.
Location Information
FLKD uses location information to support marketplace functions such as photographer discovery, service-area eligibility, event locations, photographer base markets, and Travel Availability.
Precise location information used internally for eligibility or matching is not necessarily displayed publicly. Public photographer profiles generally display location at the city/state or comparable geographic level.
FLKD does not use Travel Availability as live GPS tracking and does not represent it as a photographer’s current real-time location.
How We Use Information
We may use personal information to:
- create and maintain accounts;
- operate photographer profiles and marketplace discovery;
- process and manage booking requests;
- support availability, service-area, and Travel Availability features;
- facilitate payments, refunds, transfers, and payouts;
- provide booking-related messaging;
- deliver customer support;
- verify reviews and marketplace activity;
- detect fraud, abuse, security incidents, or violations of our policies;
- comply with legal, tax, regulatory, and payment-processing obligations;
- improve, troubleshoot, and analyze the Services; and
- communicate operational, transactional, legal, or service-related information.
How We Share Information
We may share information as necessary to operate FLKD, including with:
Customers and photographers. Information necessary to facilitate discovery, booking requests, confirmed bookings, delivery, reviews, and related marketplace interactions may be shared between users.
Service providers. We may use vendors that provide hosting, database services, analytics, customer support, communications, security, fraud prevention, payment processing, identity verification, and similar services.
Stripe and payment providers. FLKD uses Stripe and Stripe Connect for payment and marketplace payment functionality. Stripe may collect and process information under its own terms and privacy practices. Connected accounts may also have a direct contractual relationship with Stripe for applicable Stripe services.
Legal and safety purposes. We may disclose information when reasonably necessary to comply with law, enforce our agreements, protect users, investigate fraud or safety issues, or protect the rights and property of FLKD or others.
Business transactions. Information may be transferred as part of a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction, subject to applicable law.
FLKD does not currently sell personal information. FLKD does not currently share personal information for cross-context behavioral advertising. If FLKD's practices materially change, we will update this Privacy Policy and provide any choices or controls required by applicable law.
Photographer Portfolios and Public Profiles
Information intentionally placed on a public photographer profile may be visible to anyone, including users who are not signed in. This may include a photographer’s display name, city/state, sports, portfolio photographs, packages, professional information, and other information the photographer chooses to make public through FLKD.
Photographers should not include private or sensitive information in public-facing profile content.
Minors
FLKD permits eligible photographers beginning at age 14, subject to FLKD eligibility requirements.
Photographers ages 14–17 require a parent or legal guardian for applicable consent, payout, identity-verification, and compliance processes. Users under the age of majority should not independently enter into transactions or provide payment information where applicable law requires action by a parent or legal guardian.
FLKD may request age or guardian information when necessary to determine eligibility and comply with legal, safety, payment, or payout requirements.
Photos of Minors and Parent/Guardian Removal Requests
FLKD may display photographs uploaded by photographers or otherwise approved for use on FLKD-controlled websites, photographer profiles, portfolio displays, or marketing materials. A parent or legal guardian of a minor depicted in a photograph may withdraw or revoke consent previously given to FLKD for FLKD-controlled public online use of that photograph, or may request that FLKD remove the identified photograph and stop future FLKD-controlled public use of the image, by contacting info@flkdapp.com.
FLKD may take reasonable steps to verify the identity and authority of the person making the request and to identify the photograph at issue. After a verified request, FLKD will take reasonable steps to remove the identified image from FLKD-controlled public online surfaces and cease future FLKD-controlled public use, subject to applicable law and reasonable technical limitations.
This photo-removal process concerns FLKD-controlled public use of a photograph. It does not mean FLKD creates or maintains a separate personal-information profile about a minor merely because the minor appears in a photograph. A removal or withdrawal request does not require FLKD to delete a photographer's original files, remove content from an external gallery or third-party service that FLKD does not control, retrieve copies already distributed outside FLKD's control, or immediately purge archival or backup copies maintained for security or disaster-recovery purposes.
Cookies and Similar Technologies
FLKD may use cookies, local storage, SDKs, or similar technologies that are necessary for account access, security, fraud prevention, preferences, performance, and operation of the Services. FLKD may also use limited analytics technologies to understand how the Services are used and to improve reliability and performance.
FLKD does not currently use these technologies to sell personal information or share personal information for cross-context behavioral advertising. If FLKD later introduces advertising or other tracking practices that require additional notice, consent, or opt-out controls, FLKD will update this Policy and provide those controls as required by applicable law.
Where applicable law requires FLKD to recognize a legally valid browser-based privacy preference signal, FLKD will do so as required by law.
Data Retention
We retain information for as long as reasonably necessary to provide the Services, maintain business and transaction records, resolve disputes, prevent fraud, comply with legal, tax, payment, accounting, or regulatory obligations, and enforce our agreements.
Deleting an account does not necessarily require FLKD or its service providers to delete information that must be retained for legitimate legal, safety, fraud-prevention, payment, tax, or record keeping purposes.
Security
We use administrative, technical, and organizational safeguards designed to protect personal information. No system can be guaranteed to be completely secure, and FLKD cannot guarantee absolute security.
Your Privacy Choices
Depending on applicable law, you may have the right to request access to or information about personal information FLKD maintains about you, request correction of inaccurate information, or request deletion of personal information.
If applicable law gives you a right to opt out of the sale or sharing of personal information, or to limit certain uses of sensitive personal information, FLKD will provide the required method for exercising that right. FLKD does not currently sell personal information or share it for cross-context behavioral advertising.
FLKD will not unlawfully discriminate against you for exercising an applicable privacy right. Privacy requests may be submitted to privacy@flkdapp.com or by mail to FLKD LLC, 2108 N St #8197, Sacramento, CA 95816. FLKD may take reasonable steps to verify a request before acting on it.
Account Deletion
Users may request deletion of their FLKD account through available account controls or by contacting FLKD Support.
Deletion may be subject to retention requirements described above.
Third-Party Services
The Services may contain links to third-party services, such as photographer delivery galleries or other websites. Their privacy practices are governed by their own policies, not this Privacy Policy.
Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date and provide additional notice where required.
